These General Terms and Conditions govern the legal relationship between AVOXA – Mediengruppe Deutscher Apotheker GmbH, Apothekerhaus Eschborn Carl-Mannich-Straße 26, 65760 Eschborn (hereinafter “organizer”) and visitors regarding the purchase of tickets and services for the expopharm 2018 event (hereinafter “event”).
2. Exclusive validity of the GTC
The visitor recognizes these terms and conditions as a binding exclusive contractual basis with his order.
3. Conclusion of contract and scope of application
The contractual commitment with regard to the event and the sale or purchase of tickets is exclusively between the organizer and visitors. The company dimedis GmbH, Dillenburger Straße 83, 51105 Cologne, (hereinafter “service provider”) acts exclusively as commercial agent, acting in the name and for the account of the organizer and handling the purchase contract on his behalf. For this reason in particular, the service provider is not liable for the insolvency of the organizer or cancellation of the event.
With the purchase of the ticket and admission to the event, the visitor accepts the visitor terms and conditions of the organizer.
4. Registration and ticket
Each customer is obliged to provide all data requested during registration. In addition, each customer must provide a password and a user name. The customer is responsible for data protection. If the customer becomes aware of any unauthorised use of these data, he must report this to the hotline immediately (Tel. +49 6196 -928 830, firstname.lastname@example.org).
5. Invoice, payment processing
The collection of payments is carried out by the service provider. Invoices are paid exclusively to the service provider’s account. Payments via credit card collection or PayPal are made to the account of the service provider by WireCard.
In the event of non-payment of the invoice, the organizer can block access to the event. Resale of tickets to third parties is prohibited. If a ticket is not used lawfully, the organizer or service provider may invalidate the ticket.
6. Data protection
Further details can be found in the data protection regulations of the organizer.
7. Liability and Warranty
Warranty and liability shall be governed by the statutory regulations, unless otherwise regulated below. Liability for payment of damages due to compensation for material damage and pecuniary loss not occurred on the purchase item itself, is limited to cases of wilful and/or grossly negligent actions.
In all other cases, the organizer is only liable for material damage and pecuniary loss not occurred on the purchase item, in the event of a breach of essential contractual obligations. In this respect, liability is limited to foreseeable typical contractual damage. Liability for indirect or consequential damages that are contract atypical is excluded.
If the liability of the organizer is limited, this also applies to the liability of all persons whose conduct can be attributed to the organizer.
The organizer accepts no liability for the correctness of the data provided on its website.
The organizer’s offer to purchase admission tickets and catalogues through the Internet does not release the customer from the obligation to inform himself in good time and comprehensively about the relevant entry regulations to the Federal Republic of Germany, in particular also about the possible necessity of a visa. The organizer is not liable for damages and other disadvantages that could result for the customer from non-compliance with this provision.
Cancellations of tickets are only possible until the beginning of the event. The statutory right of revocation for consumers (see below clause 9) remains unaffected by this.
9. Right of withdrawal for consumers
- Revocation instruction
The visitor can revoke his contractual declaration without stating reasons within 14 days in any form (for example by letter or e-mail). The time limit begins after receipt of this instruction in text form. The timely dispatch of the revocation is sufficient to comply with the revocation period. The revocation is to be addressed to:
Avoxa – Mediengruppe Deutscher Apotheker GmbH
The revocation can be done online (by e-mail to email@example.com) or by letter to the above mentioned address.
- Revocation consequences
In the event of an effective revocation, the services already received must be returned and any benefits derived (e.g. interest) surrendered. If the customer is unable to return or surrender the service received or any of the benefits derived, compensation must be paid in this respect. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for the visitor with the sending of the cancellation, for the organizer with receipt of the cancellation.
- End of the revocation instruction
The right of revocation does not exist if the customer is not a consumer according to § 13 BGB.
10. Technical requirements
Installation of an Acrobat-Reader on the PC/Mac in use.
Use of a customary Windows / Mac printer. A valid ticket must have at least a 300 dpi resolution and may not be printed in economy quality.
White A4/Letter paper must be used. The printout must be in original size (100%).
The customer is responsible for ensuring that the barcode on the admission ticket is not smudged or damaged either on printing or at a later date.
11. Loss of tickets
If an admission ticket is lost, the organizer will send the customer a replacement admission ticket or a corresponding voucher if the customer informs the organizer of the loss by e-mail or fax prior to the start of the fair, stating the order confirmation number as well as his name and address.
The card reported lost is blocked. Access to the event is no longer possible with the blocked admission ticket.
12. Validity of tickets as travel tickets
For expopharm, the printed tickets (Print@home) for the respective period are special travel tickets valid for local roundtrip public transport. When purchasing a day ticket, the day on which the expoharm ticket is to be valid as a travel ticket must be determined. Season tickets for the event are valid as return travel tickets for the entire duration of the event.
Vouchers used for the online redemption of admission tickets, tickets for evening events and collection tickets for catalogues are not valid for travel by local public transport.
13. Final provisions
Should individual clauses of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remainder of the contract. In this case, the relevant statutory provision shall replace a provision that is not included or ineffective.
The place of jurisdiction for all disputes arising from this contract is the registered office of the organizer.
